Use of personal data
Smit & Zoon processes personal data that has been provided by you or a third party.

Depending on your status and relationship with Smit & Zoon, we may process the following personal data:

  • name/address
  • company particulars
  • email address and telephone number
  • information that is stated on an ID certificate, such as date of birth and citizen service number (BSN)
  • login details for your customer account on our website
  • financial particulars, such as IBAN
  • customer particulars provided through the customer account or contact form on our website
  • CV and motivation letter
  • registration of working hours for our employees
  • information from an assessment carried out as part of an application procedure
  • data processed in camera images in our offices and production departments
  • data processed in photos
  • data from public sources such as the chamber of commerce and the land registry
  • technical data, such as the IP number and your surfing behaviour on our website

We do not always process all of the above data. Which personal data we process in a specific case depends on your individual relationship with Smit & Zoon and, of course, the purpose of the data processing. For example, Smit & Zoon only processes the personal data on a CV if this is necessary, for example in the context of an application procedure. In accordance with the General Data Protection Regulation, Smit & Zoon keeps a processing register.

Smit & Zoon will not store the data for longer than is necessary. This means that we delete the data when it is no longer necessary for the purpose for which the data was collected or processed. For example, if an applicant is rejected and his or her data is no longer required for future application procedures, the data will be deleted. This will only be different if laws or regulations require us to retain data for longer, or data is needed for other purposes, such as generating statistical data. In the latter case, the data will be anonymised as much as possible and only data that is necessary for the other purpose will be stored and processed. In connection with possible legal disputes, Smit & Zoon stores basic data from an employee’s personnel file for seven years after they leave our employment. With a view to tax legislation, salary administration information is stored for ten years.

Purposes and legal grounds of use

We process the above personal data for the following purposes:

Execution of an agreement
An important purpose for which we process personal data is the execution of agreements with our customers, agents, employees, contractors, suppliers, etc. For example, contact details of customers are necessary in order to be able to deliver our products and services in the best possible way. Personal data of our employees and self-employed persons working for us are also required in order to be able to carry out the employment or assignment contract with them, including salary administration.

Fulfilment of legal obligations
We are obliged to process certain personal data in accordance with various laws (including tax legislation). This may include, for example, the retention of a copy of proof of identity of an employee.

Account management and maintaining contact
Contact details can be processed to maintain contact with customers, suppliers and other business relationships. These contact details are used, among other things, for sending a newsletter and for when contacting the technical service and Customer Support. Personal data may also be obtained and processed through activities on social media, including by posting photographs. The processing of personal data in this context is necessary for the representation of the interests of Smit & Zoon.

HR and recruitment
We collect and process personal data for the recruitment of new employees, the completion of job application procedures, and the hiring of new employees. This may involve, for example, personal data that has been processed in a CV or an assessment report. Once we have hired someone, the personal data is required for the performance of the employment contract, such as for the development and assessment of the employees and the salary administration (see above: the execution of the agreement). The processing of personal data in the context of the application procedure is necessary in order to take measures prior to concluding an employment or assignment agreement.

Security
In order to guarantee the security of our offices and production locations, personal data can be processed by means of, for example, camera images and access control. For security reasons, it is important that no unauthorised persons are present at the production sites and in Smit & Zoon's offices. This is checked by means of the access control and the camera images. The camera images are also used to check whether the right vehicles are on Smit & Zoon's premises and whether they are being loaded and unloaded safely. This data processing is necessary to protect the vital interests (security) of our employees, site, products and visitors, and may be necessary for the representation of the legitimate interests of Smit & Zoon.

In addition, we use a time clock system for our employees at the Weesp and Amersfoort locations, which records which employees visit the locations and when. The purpose of this is, on the one hand, to make it clear who is present in the building in the event of an evacuation and, on the other hand, to comply with the obligations arising from the Working Hours Act.

Improvement of products and services
We may process personal data in order to improve our products and services. Examples include data entered on (digital) customer satisfaction forms. Customer data may also be processed into statistical data that is used to provide insights into the quality and effectiveness of our products and services. As much as possible, Smit & Zoon will process this data anonymously or encrypted.

Finally, it is possible that personal data will be processed on the basis of the specific permission you have given for this. In that case, you have the right to withdraw your permission at any time. This can be done by sending an email to privacy@smitzoon.com, or by contacting us in another way.

Provision of personal data to third parties and international transfer
We may provide personal information to third parties, such as government agencies, but also to service providers who assist us in the execution of agreements. Examples include consultants, IT service providers or the payroll administrator. Smit & Zoon has concluded processing agreements with these third parties, which include provisions on the security of personal data.

Furthermore, we may share personal information with other Smit & Zoon offices or production sites located outside the European Economic Area (EEA), such as with our establishment in Brazil. We may also share data with third parties outside the EEA (e.g., Google Analytics). In that case, Smit & Zoon will ensure an adequate level of protection with regard to the personal data transferred. If no adequacy decision has been taken by the European Commission with regard to the country where the site in question or the third party is located, safeguards will be put in place to ensure adequate protection of personal data, for example by concluding a transfer agreement. A copy of these agreements can be requested from Smit & Zoon.

Data breaches

On discovering a (suspected) data breach, we will inform you as soon as possible about which privacy rights have probably been violated and must be reported in accordance with the General Data Protection Regulation. In addition, we are obliged to remedy or limit the consequences of the breaches as soon as possible. We will provide you with the necessary information regarding this upon request.

As far as possible, a notification will only be made to the Dutch Data Protection Authority (or an authority in another Member State) after prior consultation with you. If it is not possible to contact you within 72 hours of the data breach being detected, we will in any case report the data breach to the relevant authority. If you wish to make the report yourself, we will provide our necessary cooperation and, if necessary, we will also provide additional information to the Dutch Data Protection Authority (or an authority in another Member State) and/or the data subject. In accordance with the General Data Protection Regulation, we record all data breaches that have occurred.

Security

Smit & Zoon's websites are hosted on servers in the EEA. We also use appropriate security measures to protect your personal data and monitor this data against unauthorised access. The security measures are periodically evaluated by Smit & Zoon in order to continue to comply with the obligations pursuant to the General Data Protection Regulation and the legislation and regulations based thereon.

Your rights

On the basis of the General Data Protection Regulation, everyone whose personal data are processed with us has the right to:

  • access his or her personal data
  • correct, update, supplement, anonymise, block, limit or delete his or her personal data
  • object to the use of personal data
  • transfer personal data from us to another person or company

For the above requests, you should send an email to privacy@smitzoon.com.

If you are of the opinion that Smit & Zoon's processing of personal data infringes your rights under the General Data Protection Regulation, you have the right to lodge a complaint with the Dutch Data Protection Authority or, if applicable, the authority of another member state of the EEA.
